LINDA A. SAYERS, Respondent Below, Appellant, v. GARY GUICHARD, Petitioner Below, Appellee. No. 322, 2000. Supreme Court of the State of Delaware. Submitted: December 18, 2000. Decided: December 28, 2000.
Court Below: Family Court of the State of Delaware in and for New Castle County, C.A. No. CN98-06316.
ORDER
This 28th day of December 2000, it appears to the Court that the Clerk issued a notice dated October 17, 2000, directing the appellant to show cause why this appeal should not be dismissed, pursuant to Supreme Court Rule 29(b), for her failure to prosecute the appeal diligently by not making payment to the Family Court for the record preparation filing fee. By letter dated December 4, 2000, the Clerk further advised the appellant to pay the record preparation fee by December 18, 2000 or the notice to show cause would be deemed to be unopposed. The appellant has failed to respond to the notice to show cause or pay the record preparation fee.
Dismissal of this action, therefore, is deemed to be unopposed.
NOW, THEREFORE, IT IS ORDERED, pursuant to Supreme Court Rules 3(b) and 29(b), that the within appeal is DISMISSED.
