MUNIR v. DELAWARE EXAM. BD. OF PHYS. THERAPY, 737 A.2d 531 (Del. 1999)

Munir v. Delaware Examining Bd. of Physical Therapy.

No. 218, 1999.Supreme Court of Delaware.
August 10, 1999.

Appeal from the Superior Court, Kent County, CA 98A-09-007.

AFFIRMED

Unpublished Opinion is below.

SHAHID MUNIR, Appellant Below v. DELAWARE EXAMINING of the State of Delaware, in and BOARD OF PHYSICAL for Kent County, Appellee Below. No. 218, 1999. Supreme Court of Delaware. Submitted: July 30, 1999. Decided: August 10, 1999.

Before VEASEY, Chief Justice, HOLLAND, and BERGER, Justices.

ORDER
This 10th day of August 1999, it appears to the Court that:

(1) Shahid Munir appeals the Superior Court’s affirmance of the Delaware Examining Board of Physical Therapy’s (“the Board’s”) revocation of Munir’s Delaware license and denial of Munir’s application for licensure by examination. Munir argues, as he did in the Superior Court, that he has met the educational requirements for licensure as a physical therapist in the State of Delaware. Munir contends that the Board erred in revoking Munir’s reciprocal Delaware license and in denying Munir’s application for a Delaware license by examination.

(2) The Board has filed a motion to affirm the decision of the Superior Court, pursuant to Supreme Court Rule 25(a). The Board contends that it is manifest on the face of Munir’s opening brief that this appeal is without merit.

(3) The Court has considered Munir’s opening brief and the Board’s motion to affirm and has concluded that the judgment of the Superior Court should be affirmed on the basis of, and for the reasons assigned by, the Superior Court in its well-reasoned decision of April 26, 1999.

NOW, THEREFORE, IT IS HEREBY ORDERED that the Board’s motion to affirm is GRANTED. The judgment of the Superior Court is AFFIRMED.

BY THE COURT: Carolyn Berger Justice
