No. 35, 2004.Supreme Court of Delaware.Submitted: January 29, 2004.
Decided: February 10, 2004.
Board Case No. 56, 2003.
Before BERGER, STEELE, and JACOBS, Justices.
ORDER
Myron T. Steele, Justice.
This 10th day of February 2004, it appears to the Court that:
(1) On May 2, 2003, the Court suspended the petitioner, James Bailey, from the practice of law for a period of six months and one day beginning June 1, 2003. On December 2, 2003, Bailey filed an application for reinstatement to active status with the Board on Professional Responsibility. The Office of Disciplinary Counsel did not file any objections to Bailey’s petition.
(2) Following a hearing, the Board on Professional Responsibility filed its report, which concluded that Bailey had proven his rehabilitation as required by Rule 22 of the Delaware Lawyers’ Rules of Disciplinary Procedure and recommended that Bailey be reinstated to practice law without conditions. The ODC agrees with the Board’s findings and recommendations.
(3) The Court has reviewed the Board’s Report and Recommendations carefully. The Court has determined that the Board’s Report and Recommendations are appropriate and should be adopted.
NOW, THEREFORE, IT IS ORDERED the Board’s Report and Recommendations are hereby ACCEPTED. Bailey shall be reinstated, effective immediately, as a member of the Bar of this Court.
