No. 367, 1999.Supreme Court of Delaware.Submitted: December 15, 1999.
Decided: December 20, 1999.
Court Below: Superior Court of the State of Delaware in and for Sussex County, C.A. No. 98C-07-014.
AFFIRMED.
Before WALSH, HOLLAND, and HARTNETT, Justices.
ORDER
This 20th day of December 1999, upon consideration of the briefs of the parties, this Court concludes that the trial court did not err in denying appellant’s request to vacate the default judgment given the unusual circumstances of this case. The trial court’s decision to reopen a default judgment, or to deny such relief, is within that court’s sound discretion. Battaglia v. Wilmington Sav. Fund Soc., Del. Supr., 379 A.2d 1133, 1135 (1977). We find no abuse of that discretion.
NOW, THEREFORE, IT IS ORDERED that this matter be, and the same hereby is,
AFFIRMED.
