Bayard’s Notebook, 109.[*]
Supreme Court of Delaware, Sussex County.
October, 1795.
The defendant’s counsel offered in evidence a paper purporting to be the copy of the last will of one Robert Snead. It was certified to be a true copy by one Lyttleton Savage, who signed the certificate as Clerk of Accomack County, Virginia. It was objected by the plaintiff’s counsel that the copy was not authentic or admissible evidence without the seal of the clerk’s office to the certificate.
Upon the ground of this objection the Court rejected the paper.
Peery, Miller and Wilson for plaintiff. Ridgely an Bayard for defendant.
